On March 28, 2013, Lê & Lê succeeded in opposition against trademark “Pentax WATER PUMPS & device” for “water jet pumps, high-pressure pumps” in Application No. 4-2009-24034 in the name of Nguyen An Company Ltd. on the following grounds: (i) there was a likelihood of confusion between the opposed trademark and the earlier trademarks containing PENTAX and PENTAX is a famous registered mark having broader scope of protection on non-competing goods; (ii) the opposed trademark is likely to lead to considerable confusion of the trade names of the companies of Hoya Corporation; and (iii) Applying the opposed trademark for registration constitutes unfair competition.
