On 10 November 2004, Lê & Lê completed its 85-paged written proposal on building the Law on Geographic Indications (GI) written by Lê & Lê ’s attorneys (Le Hoai Duong and Dieu Ngoc Tuan) in 3-month period at the request of the Club for Agricultural Product Brand (CAB). The written proposal is aimed at initiating the most effective legal system for the protection of GI in Vietnam, contributing for and enhancing the position of brands of Vietnamese agricultural products in the international market.
Contents of the written proposal are detailed with reasons and practices of the promulgation of law on GI protection, namely: introduction on GI Protection; forms of GI protection in some jurisdictions; the present protection of GI in Vietnam and its level of compatibility with the TRIPS's requirements; and the necessity of completing the law on GI in Vietnam. Also in this proposal, Lê & Lê mentioned specific initiatives for completing the law on GI in Vietnam and put forward a draft law on GI including 6 Chapters, 35 Articles.
The CAB shall send this written proposal to experts for further comments before submitting to the National Assembly and relating organs.
