After four working months, a group of experts (including two international experts and one local expert from LÊ & LÊ Law Firm) has completed a report representing to the Vietnamese Government, suggesting 5 solutions to facilitate the access to affordable ARV drugs for Vietnam. These 5 solutions are the result of the study and analysis of Vietnam and international regulations on intellectual property, Vietnam laws and regulations on registration, manufacture and importation of drugs, and a complete search of any Vietnam issued patents and pending patent applications that might cover the 22 WHO-suggested antiretroviral drugs. Based on the analysis of Vietnam and international legal regulations on IP and Vietnam patent protection situation related to 22 antiretroviral drugs provided by WHO, on 29 June 2004 in Hanoi, this report was presented to competent authorities of the Government and, National Assembly, and international agencies, organizations for additional ideas and comments. Representatives from the Ministry of Foreign Affair, Ministry of Health, National Committee for Union of International Economic Cooperation Integration, the National Office of Intellectual Property, and the Brazil Embassy to Vietnam highly appreciated the report and unanimously supposed that the 05 given solutions are reasonable and feasible.
